Benjamin provides legal support and advice on all stages of tax credit financing, with a focus on new markets tax credits (NMTC) and Low-Income Housing Tax Credits (LIHTC).  His expertise is centered around corporate structure, company formation, and inter-company agreements, and he specializes in navigating he complex transactional structure of tax credit investments.

As part of his NMTC practice, Benjamin has represented community development organizations deploying over $100,000,000 of NMTC allocation to worthy construction projects in Colorado, including food banks, libraries, and shelters for people experiencing homelessness.  He has also represented the beneficiaries of NMTC financing across the nation, including both for-profit companies and nonprofit entities engaged in charitable work, medicine, and education, among other fields.

Benjamin represents LIHTC investors and syndicators operating nationwide, and has done extensive drafting work on limited partnership agreements, operating agreements, and ancillary documents to ensure that the LIHTC investors are protected and achieve their investment goals.  He further provides investor-focused review of loan documents and has directly saved investors $20,000 in bank fees on a single transaction.

Benjamin has also successfully represented both the lender-side and developer-side in several combination transactions, combining different types of tax credits, including NMTC, 4% LIHTC, and 9% LIHTC investments, in one project financing.
